    Student’s Name Professor’s Name Course Date Sheldon Wolin, “Fugitive Democracy” and “Norm & Form” Introduction Sheldon Wolin on “Fugitive Democracy” and “Norm & Form” is concerned with the political uses and significance of democracy in regard to two entirely opposed ideas that illustrate two equally contrasting states of affairs (Wolin, 29). First, Woldin states that democracy represents of government and political authority normally referred to as a constitution. Second, he speaks of the revolution, unsettling political movement. According to Woldin, the constitution symbolizes the repression of the revolution, while the revolution the demolition of the constitution. The two opposing notions are interlinked by democracy. There is a great need to reconceived democracy not as a type of government, it should be defined as a form of being that is as a result of bitter incidents, and is destined to temporarily succeed (Wolin, 43). Democracy is a rebellious and political moment that assumes destructive and revolutionary proportions. Democracy in Ancient Times Traditionally, democracy has been defined as a type of government in which citizens are vested with supreme power. A democratic state is characterized with proper equality of privileges and rights, social or political equality, and a democratic spirit. The main role of democracy was to transform politics in speech and sight, make power visible, and make decision making open so that ordinary men could have power. Over a period of time, democratic theorists such as Woldin, have primarily concerned themselves with examining the meaning and definition of the notion of democracy, while simultaneously focusing on its obligations, moral foundations, challenges, and general allure of a democratic governance. Democracy in the modern world cannot be perceived as a whole political system, provided with the great potentialities of modern power forms, and its impact on the natural and social world (Wolin, 42). Modern Democracy There is a great difference between facets of democracy in the organizational impulses of modern and ancient constitutionalism. Democracy from primeval to modern times has allegedly weakened the power of law, and the practice of compliance to government. Initially, demos were used to change the political art practice where the elite competed for office and honors. Currently, demos are used to reverse the worldwide trends of institutionalized power systems to benefit a few and exploit many citizens (Wolin, 48). The rupture between modern and ancient democracy conceptions should be considered as the needed foundation for the development of modern democracy. This is because the social complexity, large populations, and great physical dimensions make the politics of a small polis old-fashioned. Conclusion There is a need to renew democracy through relying on voluntary associations. “Voluntary associations are often see as a key to enhancing political participation in the wider community” (Eikenberry, 7). Ordinary citizens have the capability of developing new cultural patterns of unity at any moment. People who use their power for improved healthcare, better schools, safer water, low income housing among others are (without their knowledge) renewing the democracy. “Philanthropic supporters enable the provision of a broad array of activities and activities that may not be provided otherwise” (Eikenberry, 16). Self- governing and independent voluntary associations should always replace hierarchical corporate authorities. This provides the affected interests with voices, hence promoting government through consent in the entire society, and not just in the state. Through such actions, the state complexity will be reduced and the ancient democratic representative mechanisms shall be able to function effectively.

An example is that a family may raise their children in the Jewish faith but the children may not hold this same belief themselves and may, as adults, live a life that does not uphold any of the traditional Jewish values. (Words 700) Youth homelessness Going by the statistics, approximately 39 % the total number of people without homes fall under the age bracket of 25 years of age or below. This statistics is quite alarming and disturbing since it leads to destruction of the lives of the younger generation and their future becomes ruined as a result. Homelessness among the youth denies the youth the right to education and belonging and the privilege thereof. There is also the impact of the mental and psychological effects that are brought about by the lack of directions and rules that exist in a family set up[ CITATION Rog13 \l 1033 ]. A large number of the youth become homeless due to the use and abuse of drugs that may result from peer influence, about 75% of the homeless youth are drug abusers. Abuse of drugs lead to mental influence which in turn lead to lack of interest in basic things such as education, the mental disorder caused by the use of drugs also lead to the indiscipline and crimes among the youth and in turn force the parents to withdraw their financial, social and emotional support from their children. The kids may be kicked out of their homes by their parents, make just sneak away at their own will or may also sneak out of the correctional facilities into the streets[ CITATION Rob08 \l 1033 ]. Life in the streets is not always a ride in the park, the youth in the streets face a lot of challenges and difficulties, this ranges from assault by the public or fellow homeless kids, lack of food, illnesses and diseases and suicide among the youth. Such hardships lead to loss of about 5000 lives of young people in the US. Another issue that lead to homelessness is the lack care and love in the families, some parents are too harsh and hard on their children due to their dictatorial rule, their children therefore opt out of their homes in search of more friendly environment where their emotions can be pampered and their needs can be well taken care of. They then hope that the streets will offer such environment but are again disappointed by the more harsh environment outside. Another important note to be put forward is that teens between the ages of 12 and 17 are more likely to become homeless that any other age bracket, this is because they go through a lot of psychological, emotional and physical changes that need to be properly understood by the parents[ CITATION Mar072 \l 1033 ]. There is also the influence of the peer pressure among the youth within such age bracket that may turn around the thought of the youth to a totally spoilt and indiscipline generation. There are various consequences that come with homelessness among the youth, example of such are like engaging in unprotected sex, engaging in several sexual escapades with several people and also engaging in drug abuse. Such unhealthy activities may lead one to contacting diseases such as HIV, can lead to health complications and blood related disorders and also injuries can result from the use and sharing of the needles. Such activities also lead to unhealthy lifestyles, shaky relationships, unwanted pregnancies, increase in the number of street children and premature deaths. There is also a an increase in the number of gay, lesbian, bisexual and transgender youth that lead to increase in the social decay in the society which misleads the future generation. Activities such as prostitution, exchange sex for housing and general increase in rape cases in the society, this provides a very volatile society in the making which is not capable of pushing and supporting the social moral agendas forward.

People get to learn about issues such as the climatic change, environmental degradation and the ways of restoring and maintaining a clean environment. There are lot of problems that come with the deficit model, one is that, the explanations that are laid out proves to be difficult to understand and in turn hinder people from talking and discussing on the proposed ideas of the model. Such ideas like trust that people hold with each other, the identity that people own such as the culture, origin, race and history, and lastly, the worldview of each individual. It states that in order to adequately understand how technology is used, one must first understand how technology is intertwined in the social context and its effects in the society. Therefore, there must be a smooth correlation and coexistence between the two and a middle ground must be found and well defined in order to avoid the situation where one overrides the other since the society cannot exist without one of the two issues. SCOT is a theory and a methodology that researchers and scientists have formed and unanimously adopted in the analysis of success and failures technology, SCOT offers steps to be followed and principles to be adopted in such analyses. In order to fully understand SCOT and the framework that formulates it, there should be analysis of four of its components. One of such components is the interpretive flexibility. This concept argues that the design of technology is a very wide process and as such, the outcomes of any improvement in the technology is greatly influenced and affected by the social circumstances on which the technological developments are made. As such, the theory suggest that a great scientific idea can be developed that is beneficial to the general population, but that same idea can be introduced in a negative social setting that is against it and will in turn lead to its misuse, misunderstanding and misapplication. Body Question 1 According to section 6.40(c) of the legal capital rules, it states that “the corporation would not be able to pay its debt as they become due in the usual course of business,” and also “the corporation`s total assets would be less than the sum of its total liabilities plus the amount that would be needed, if the corporation were to be dissolved in the time if distribution.” The Model Business Corporation Act (MBCA) was on the other hand founded in 1950 to tackle and solve problems resulting from different views that different states had with regard to corporations, such different views resulted in several promoters being charged for cases that concerned the corporations[ CITATION Cra08 \l 1033 ]. The widespread use of MBCA brought some sanity into the matter and many states have adopted the act and are now governed by the revised model of the act. The advantage of the legal capital rules is that is not applicable in every respect of the management hence the amount of capital is not always contributed and maintained by the company. Also, the rules are formed such that only corporations are subject to such laws and organizations such as partnerships and limited companies are not subject so such laws and are therefore certain companies do not get involved in the inefficiency of the rule[ CITATION Jos13 \l 1033 ]. The disadvantage of the act is that the government has the leverage of calling for and the formation of a federal incorporation law which can have some unspecified and unforeseen restrictions that the government could impose on the businesses and companies, It is also perceived that the act offers some soft grounds to the management and could indeed oppress the stakeholders. The European Union Second Council Directive on the other hand is a law that is created by the powers bestowed in the European Union and it is concerned with limiting the payments of dividends, to receive and resolve claims concerning returns of dividends that are not lawfully received, calling for an urgent and general meeting in the case of a serious loss in any company, limiting the acquisition of personal shares and accepting shares of an individual or a company as security. The advantage of the legal capital rules to the directive is that it helps in the solving of claims that rise between the shareholders and the creditors hence it is a way of advocating for the rights of the creditors, also, by limiting personal shares, there is increase in the growth of the company revenues and not individuals and an urge for every shareholder to advocate for the perpetuation of the company[ CITATION Jam11 \l 1033 ]. Nevertheless, some disadvantages posed on the second directive by the legal capital rules is that, by limiting the amount of dividends paid to the shareholders, the shareholders receive a very small amount of capital which could lead to withdrawal of some shareholders from the company and which could in turn lead to the collapse of the company. Question 2 The Board of Directors are professional individuals that are elected by the shareholders of a given company and are entrusted with functions such as to represent the shareholders in the company, to form the management and policies of the company, to hire and otherwise fire executives, to make policies that deal with how dividends are distributed among the shareholders and matters dealing with executive compensation. As stated above, the main objective of the legal capital rules is to reconcile issues arising from creditors and shareholder due to the distribution of dividends and give the creditors and edge in the distribution of company`s capital over the shareholders. The board of directors on the other hand have the mandate and authority to advocate for the rights of the shareholders, these conflicting authorities of the board and the capital rules result may result in the stalling of the company`s projects unless a clear boundary is drawn between the two[ CITATION Cra08 \l 1033 ]. Also, the mandate of resolving conflict between the shareholders and the creditors is stipulated in the capital rules that all conflict arising as such should be solved with reference to the capital act, on the other hand, the board of directors argue it that it is their mandate to run the company and oversee all the departments of the company and are the sole decision makers and are not subject to any rules or acts. In the minimum capital rule under the legal capital law, there is no clear provision on the minimum amount of capital requirement for private companies, on the other hand, the board of directors must specify the amount of capital required in order to start a given business, the minimum amount varies from one business to another[ CITATION Jos13 \l 1033 ]. The contrast in the authorities of the board and the provisions in the Act may lead an individual who has interest in buying of shares of a certain company to decline, and whether or not a minimum amount of capital required should be considered or not. This in turn can lead the public and the shareholders into lacking faith in the management and authority in the board citing poor management. In the distribution rules of the legal capital rules, the rule does not allow a company to distribute capital to its shareholders in case the assets of the stated company are less and does not exceed a stated value of its capital accounts[ CITATION Cra08 \l 1033 ]. On the other hand, the board of directors insist that the shareholders can get disbursement of a specified capital according to the agreement made during the signing of the memorandum of understanding when buying shares in the company. There is no clear basis as to whether or not disbursements should be made to the shareholders` account regardless of the financial state of the company, the board insist that the memorandum of understanding signed should override any person or any rules Question 3 The legal capital rules that are most beneficial to companies are such as the formation rules. The rule proposes the use of minimum amount of capital that one requires to get limited liability in a company, such attempts and rules have much effect on small companies that have minimum capital requirement in order to operate and run, in such firms, the companies are owned by the owners and no risk is extended to the shareholders. The use and implementation of formation rules is that it helps in making businesses more appealing to the individuals who are interested in less risks, another advantage also is that it helps individuals to gain access to limited liability, since they lack the required amount of resources to acquire the required liability in a company[ CITATION Jam11 \l 1033 ]. Such advances encourage individuals to engage in entrepreneurial activities and in turn help the limited companies to raise a higher amount of funds to run the company. Another rule which is proposed is the distribution rule that upholds another rule in the legal capital requirement rule that disbursements should not be made to shareholders` account in the a firm faces a financial crisis. The rule then suggests that, the shareholders should be allowed to take loans from such firms and in such periods of financial difficulty. This move will help the company and the shareholders at the same time, in that as the shareholders will acquire loans, some interest will be charged on the loans which serves to uplift the company during such times of financial difficulty. On the other hand, the shareholders also will get some cash in case they are in any financial crises[ CITATION Joh06 \l 1033 ]. The minimum capital rule is a rule that attached some minimum amount of capital requirement to be imposed on the individuals wishing to purchase some shares from a company, this ensures that only serious individuals can buy shares from such companies and people that can make personal sacrifices to see the company grow forward, it ensures that only individuals that can stand with the company in the times of financial crisis can buy the shares, also, the rule increases the amount of capital for the business to operate. The minimum capital rule has a major advantage for any company in that it helps the government in setting tax burdens for the companies and hence is a good way of calculating the amount of tax that different companies should remit to the government. Self- governing and independent voluntary associations should always replace hierarchical corporate authorities. This provides the affected interests with voices, hence promoting government through consent in the entire society, and not just in the state. A person may come from a cultural background but not hold all of the same beliefs or customs as others from that background. An example is that a family may raise their children in the Jewish faith but the children may not hold this same belief themselves and may, as adults, live a life that does not uphold any of the traditional Jewish values. For example, the children might not: marry someone from the Jewish faith; celebrate Jewish festivals; speak Hebrew; follow dietary restrictions such as refraining from eating pork or shellfish.
